1. Who we are
SwitchYard is provided by Pedro José Arenas Férriz, with tax identification number 44757791K and address at C/ Lolita Miralles Esteve, 8, 3º D, 03600 Elda (Alicante), España (“we” in these terms). You can write to us at privacy@switchyardhq.io.
2. What these terms cover
These terms apply to this website and to the form for asking for access. They also apply to the use of SwitchYard itself (the web app, its API and the Local Agent) during its closed alpha, as section 5 describes. By using any of them you accept these terms. How we handle personal data is explained in the privacy policy.
3. The website
The website describes SwitchYard. We try to keep it accurate, but what it describes changes, especially during the alpha, and nothing on it is an offer. Links to other websites are given for your convenience; we are not responsible for their content.
4. Asking for access
- Send only true information, and only your own email address.
- Sending the form does not give you access, nor does it oblige us to give it: we decide each request, and we may decline it without giving reasons.
- If we approve it, you receive an email inviting you to create your organization in SwitchYard.
- We keep one request per email address, and we delete without a reply any message that is not a genuine request.
5. Using SwitchYard during the closed alpha
An alpha. SwitchYard is in a closed alpha: it is still being built, it changes, and it may have errors, be interrupted or stop. It is provided as it is and as available, with no commitment on availability. We may change, suspend or end SwitchYard, or your access to it, at any time, and we will try to tell you in advance whenever we can.
Free of charge. Using SwitchYard during the closed alpha is free. If we offer paid plans, they will come with their own conditions, and nothing will be charged without your express agreement.
Your account and your organization. Access is by invitation. You are responsible for what is done with your account and with your organization’s API keys and enrollment tokens: keep them secret, and revoke any you believe has been exposed. Your organization’s Owners decide who joins it and what each person can do.
Your content. Your code, repositories, tasks, workflows and operations, and everything your agents and commands produce, remain yours or your organization’s. You give us only the permission we need to store, process and transmit them in order to run SwitchYard for you, and we use them for nothing else. You must have the right to use whatever you bring into SwitchYard.
Your machines and your agents. SwitchYard coordinates the work; the work runs on the machines you connect, with the agents and commands you choose. An agent can change the files of the repositories it works on and run commands on your machine with the permissions you give it, so review what it produces before you rely on it, and connect only machines you control. A machine you connect can run work from any project of your organization. Each agent provider (for example Anthropic, OpenAI, Cursor or GitHub) has its own terms, and you are responsible for following them with the accounts you connect; a personal subscription, in particular, is usually meant only for its holder’s own work.
Acceptable use. Do not use SwitchYard to break the law or anyone’s rights; to try to reach data or functions you have not been given access to, including other organizations’ data; to probe, overload or disrupt it; or to get around its limits or its security. We may suspend any access that breaks these rules.
When it ends. You can stop using SwitchYard at any time. An Owner of your organization can ask us at privacy@switchyardhq.io for a copy of your organization’s data or for its deletion, as the privacy policy explains.
6. Intellectual property
The website and SwitchYard, including its software, its name and its logo, belong to us or to our licensors. These terms give you no right to them beyond using them as these terms describe.
7. Liability
As far as the law allows, we are not liable for indirect losses, such as lost profits, lost business or lost data, nor for what the agents, commands, machines or providers you choose do. Nothing in these terms limits a liability that the law does not allow to be limited, such as for intent or gross negligence, nor your rights as a consumer, if you are one.
8. Changes to these terms
We may change these terms. We will publish the new version here with its date and, if a change is significant, tell account holders by email before it applies. If you keep using SwitchYard after that, you accept the new version.
9. Applicable law and courts
These terms are governed by Spanish law. If you are not a consumer, any dispute about them, this website or SwitchYard will be submitted to the courts of Elda (Alicante, Spain).
If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, nor of your right to go to its courts.
